The Sub-Committee considered an application, to which representations had been made, for the variation of the Premises Licence issued in respect of The Corner Pin, Slade Green Road, Erith, Kent DA8 2HX.
The Chairman opened the Committee with an introduction on the purposes of the committee and asked members, officers and the applicant to introduce themselves.
The Chairman then invited Mr Kevin O’Brien-Wheeler (Senior Environmental Health Officer) to speak on behalf of Environmental Health. Mr O’Brien Wheeler directed Members to Page 55 of the report before them, which contained details of Environmental Health Service’s representations on the application. Mr O’Brien-Wheeler confirmed that he had since spoken to Mr David Edward Alan Clark (Applicant) about his application and was satisfied that he no longer required a condition for bullet point three and raised no objection to removing Condition 14, which was time limited and had become redundant in November 2010. Mr O’Brien-Wheeler also drew Members attention to Mr Clark’s letter of 6 September, which confirmed he had accepted the condition contained in bullet point one of the email and provided more information to mitigate the concerns raised in bullet point two and condition 13, that prevented taking drinks from the premises for consumption outside at the front of the premises.
The Chairman asked Mr O’Brien-Wheeler if he had received complaints with regards to public disorder or to the level of noise emanating from the premises. Mr O’Brien-Wheeler said that there had been none reported.
The Chairman also asked Mr O’Brien-Wheeler whether he thought an additional condition should be added for glass control on the forecourt. Mr O’Brien-Wheeler said there had been one incident last year, at the front of the premises, where police were called. He advised Members that a change of management had dealt with this disorder and as there had been no other complaints reported over the last year, he had no reason to believe this was an on ongoing problem and on that basis considered there was no need to add a condition for glass control. However, Mr O’Brien-Wheeler added that whilst glass control could also be dealt with under other legislation there was nothing preventing Members from requesting an additional condition for this.
Mr Clark, was then invited to give evidence to the Sub-Committee. Mr Clark said that he agreed with all the conditions Mr Brien-Wheeler had raised in his presentation. He also added that apart from the isolated incident caused by the previous managers there had been no complaints of note in the past 40 years he had owned the premises and was confident this would continue now that this daughter, Ms Jane Bentley (live in DPS), was manager. Having given his evidence, Mr Clark invited his witness Mr Alan Casey to speak. In response to Members questions, Mr Casey confirmed that he lived at No. 1 Hazell Road, DA8 2LT for the past 5 years and used the pub frequently.
